Amazingly we (the real estate industry) went from at least three important lawsuits that could have a significant effect on Broker compensation to many. many, many. The most well-known is still the Moehrl case filed in 2019. The lawsuit which lists as defendants, the National Association of REALTORS, about 20 MLS’s, and four huge brokerages (Keller Williams, Berkshire Hathaway, RE/MAX and the Anywhere brands (the last two settled)), alleges that some NAR rules violate anti-trust laws by inflating seller costs by requiring that they pay cooperating buyer brokers a fee to list their property. There was also a suit in Missouri, the Burnett case, which rendered a verdict against REALTORS everywhere. Presently there are close to 20 similar lawsuits across the country.
This two-hour session is designed to deliver two things: 1) give background on the cases and key issues, and 2) share strategies for agents to get ahead of this wave of potential change. There is no doubt that no matter how any of the cases are decided, the impact on our business will be powerful.
